intake aperture is then under the windscreen: much higher and protected

miniscule sound affect with foam sound dampers
ATTENTION: warranty effect due to change of air intake
no approvement problems known until now, by law it should be approved
option: sound-dampening foam set, see below

In theory, VW might refuse any warranty for cars with such a modification. But afaik all cars with 80mm diameter parts are out of warranty anyway.

In any case, Relleumdesign does not give any kind of warranty for engine damages as the use in rough terrain is not covered by the vehicles specifications and cannot be specified or defined. When deep fording, water could still get into the engine. This is in responsibility of the driver.
